Terms and Conditions

 

1.    Deposit, Payment of purchase price, fees

 

A non-refundable deposit of $____________ is hereby made and the cash balance is due to Seller before this dog is placed in the Buyer’s possession. Deposit may be used on a future litter if buyer changes their mind before the puppy is 6 weeks of age. The Buyer understands that once a deposit is made, it is a commitment to buy said dog and is therefore NON-REFUNDABLE but transferable to a puppy in a future litter if desired. Deposits are transferable for 2 years. Seller accepts cash or funds via email money transfer for the DEPOSIT ONLY. ONLY CASH IS ACCEPTED WHEN PICKING UP YOUR PUPPY.

 

 

 

 

 

2.Transfer of Ownership and Registration

 

Upon payment in full of the purchase price, Seller shall promptly take all action required to officially transfer ownership and registration of the dog to buyer. Seller will mail original certificate to buyer. A photo copy of certificate will be filed with the seller.

 

 

   Seller’s Representations and Warranties

 

Seller represents and warrants to buyer that:

1.    Seller is the legal and true owner of the dog and that Seller has full right and authority to sell the dog.

2.    The dog is being sold free and clear of any lien, security interest, charge or other encumbrance.

3.    Seller guarantees that the dog is a purebred dog, offspring of the purebred sire and purebred dam.

4.    Seller has taken the steps necessary to ensure that the dog is current on all vaccinations as per veterinary guidelines.

5.    Seller will provide written documentation that the dog has received routine vaccinations and an exam by a licensed veterinarian, who has deemed the dog to be in good health.  The name and contact information of our veterinarian will be included on the dogs’ record of health. Seller guarantees dog to be free of external, internal parasites. Although a complete veterinary inspection will be done, sometimes something might be missed.

6.    The puppy has been feed (will advise at time of purchase). I advise continuing this food or choosing a high quality puppy feed.

7.    Seller has no obligation under any circumstances to reimburse Buyer for any costs incurred, i.e., medical, shipping, etc. Seller does not Guarantee against conditions brought on by stress or environmental changes that we cannot control once the puppy leaves our care; therefore, our guarantee does not cover any contagious disease that can be contracted immediately upon leaving our property or hypoglycemia, parasites, giardia, viral or bacterial infections, against parvo, coccidiosis, distemper or corona virus, any kind of skin allergies and Seller makes no guarantee as to puppy's fertility or breeding abilities. Breeder cannot guarantee exact size, ear type, or coat type.  Guaranteed to be free from any genetic/hereditary defects that cause death until the puppy is TWO years of age. If such an inheritable death is documented by a veterinarian and presented to seller, the buyer will be entitled to a replacement puppy. This guarantee does not include Viral Illnesses, Demodectic/Sarcoptic mange, heatstroke, Infections, Improper Bites, Entropion, Intervertebral Disk Disease, Distichiasis, Hernias, Hypoglycemia, Guardia or Coccidiosis, Cancers, Allergies, dental problems, Mild Skin Conditions, Diabetes, Grade 1 or 2 Heart Murmurs or an occasional seizure. It also does not include any illness due to the ingestion of foreign objects, food, chemicals, medication, or physical injury. It does not cover a parasite infestation (Fleas, Ticks, and Worms) due to Human Neglect. The life threatening genetic defects warranty does not cover temperament of the dog. The dog must be spayed or neutered to receive a refund at six months of age.  If the puppy has a life threatening genetic defect detected by a licensed veterinarian within the two year (guarantee ends when pup turns 2 years old) a another dog of equal value, the choice to be determined by Seller. Buyer must return puppy (at buyer’s expense) and puppy’s paperwork to the Seller within 1 month of the exam that detected the defect before replacement will be made. Seller must also have a letter from their veterinarian with his address, telephone and the defect detected before any replacement puppy is given. A second certified veterinarian will be selected by the breeder to have a second opinion to determine the illness. If the Buyer refuse to return this puppy for a replacement puppy then this guarantee is null and void. All above Veterinarian fees are paid at the owner expense. Buyer must also produce the veterinarian receipt from the first 2 days of purchase or this guarantee is null/void.
THE PUPPY MUST BE SPAYED/NEUTERED AT THE AGE OF SIX MONTHS or this guarantee is null and void. Proof of vet bill to be shown.

8.    Should puppy die from communicable disease (this does not include parasites or hypoglycemia) within 2 days of purchase and buyer promptly sought treatment by certified veterinarian, and if said vet certifies in writing and attached pictures of said pup in the veterinarian office. If certified Veterinarian is thought puppy to have been exposed to the disease prior to leaving our home, buyer will get FULL refund of PURCHASE PRICE of puppy or replacement puppy of equal or greater value as determined by the seller within 90 days of certification of death and the autopsy report, whichever comes last.  Buyer must send certification (autopsy required) to Seller within 4 weeks of pup’s death.
All above Veterinarian fees are paid at the owner expense. 

 

 

     Buyer Responsibilities

 

Buyer agrees to be responsible in providing a healthy home environment for dog, including but not limited to:

 

1.    Proper and secure space

2.    Plenty of exercise

3.    Discipline, including proper socialization

4.    Proper nourishment and healthcare.

5.    If the dog develops a health issue at a date occurring later then the date of sale, the buyer will not hold seller responsible.

6.    Once the dog is in the Buyers possession, Buyer agrees to hold Seller harmless from any loss Buyer might sustain due to ownership of dog. Seller is not responsible for dog, any of its actions or actions of Buyer concerning the dog once sale is complete.

7.    Within 2 days of receipt of dog, Buyer is required to have licensed veterinarian examine the dog with written documentation of the dogs’ good health.  Buyer will notify Seller if the dog is found to have any life threatening condition; upon proof of written documentation from your veterinarian the Buyer may return the dog to Seller for replacement or refund. It is at the Sellers sole discretion as to the replacement/refund.  The puppy cannot be refunded after the guarantee period has expired and/or if it has been exposed to another dog, which has not been currently vaccinated.

8.    Under NO circumstances will the dog be re-sold, leased or given away, to another person, pet shop, research laboratory or similar facility.  If you no longer want to care for this dog, it must be return to Triggerpoint Kennels to be rehomed.  No refund will be given.

9.    If the dog is found to be abused, neglected, or mistreated, the purchaser will surrender it to the seller, unconditionally and with no intention of any refund.

10. It is the responsibility of the buyer to provide immediate vet care to any puppy showing signs of illness or distress, and failure to do so will render any guarantee null or void. If veterinarian care is ignored or not applied as prescribed, all claims to a replacement animal or refund or reimbursement of medicines.  If a puppy dies within the guarantee period, despite medical treatment, compensation will be made only if a licensed veterinarian certifies the cause of death is not due to buyer’s negligence.

11. Due to many factors in rearing and caring for the puppy that are beyond the control of the seller, there is no guarantee on temperament and size.

12. At the expense of the BUYER, this dog will be examined by a licensed veterinarian at a wellness check within 2 DAYS of possession to validate Health Guarantee. Paperwork from vet check should be photocopied and mailed or emailed to above address with 5 days of purchase.  Buyer agrees to activate pet insurance at this time during the adjustment period or this guarantee is null/void.

 

 

 

The parties accept and agree to be bound by the attached Terms and Conditions governing to purchase and sale of dog. IT IS HEREBY AGREED BY BOTH PARTIES THAT THE FOLLOWING CONDITIONS WILL BE MET AND THAT NO OTHER WARRANTIES OR CONDITIONS ARE EXPRESSED OR IMPLIED.

 

 

This contract is legal and binding to all parties involved.  It is only the buyer and seller in this original transaction and is not transferable to other parties. By signing below, the buyer and the seller agrees to the terms and conditions of this contract.

 

BREEDER RESERVES THE RIGHT TO REFUSE SALE OF THE PUPPY, AT ANY TIME WITH ANY REASON. In this case deposit will be refunded in full immediately.
